Maternité sans danger
It depends. You must have an employment contract with your company and pay yourself a salary. If you only pay yourself dividends, without an employment contract, you might not be eligible.
You must obtain the Preventive Withdrawal Certificate (also called the Certificate for the Assignment or Preventive Withdrawal of a Pregnant or Breastfeeding Worker) from your doctor.
Your preventive withdrawal only begins if:
-
You have submitted the Preventive Withdrawal Certificate
AND
-
The producer is unable to reassign you to other safe tasks.
You are entitled to CNESST benefits:
-
From the moment you submit your certificate,
-
Until the 4th week preceding your expected due date.
IMPORTANT: According to the Administrative Labour Tribunal (TAT), you are entitled to income replacement benefits even after your contract with the producer ends.
-
Days 1 to 5: The producer pays you 100% of your projected gross salary.
-
Days 6 to 19: The producer pays you 90% of your net salary and is reimbursed by the CNESST.
-
From day 20 onwards: The CNESST takes over and pays you benefits directly every two weeks.
If you are eligible for the program, you will receive 90% of your net employment income, paid every two weeks by the CNESST, after the initial five (5) day period covered by the producer.
AQTIS 514 IATSE handles the follow-up of your file with the CNESST and with the producer.
We also support you in any dispute of a decision that would cause you to lose benefits to which you are entitled.
